TERMS OF SERVICE

1. Overview
Welcome to ARTI Pickleball (“ARTI,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, content, and features (the “Services”), including any purchase you make through playwitharti.com (the “Site”).
By accessing the Site or purchasing from us, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility
You must be at least the age of majority in your state or province of residence to place an order. If you are under the age of majority, you may only use the Site with the involvement and permission of a parent or legal guardian.

3. Account Creation and Security
Some parts of the Site may require an account. You agree to:

  • Provide accurate, current, and complete information.

  • Maintain and promptly update your information.

  • Keep your login credentials confidential and accept responsibility for all activity under your account.
    We reserve the right to refuse service, terminate accounts, or cancel orders if we believe these Terms are violated or if we believe it is in our best interest to do so.

4. Orders and Payment
When you place an order, you are offering to buy a product. We may accept or reject any order at our sole discretion, including for reasons such as product availability, suspected fraud, or pricing errors.
You agree to provide a valid payment method and authorize us (and our payment processors) to charge that method for the total amount shown at checkout, including taxes, shipping, and any other charges.
All prices are in U.S. dollars unless stated otherwise.
If we cancel an order after you’ve been charged, we will issue a refund to your original payment method.

5. Shipping & Delivery
Shipping and delivery details (including handling time, carrier timing, and free shipping thresholds) are described in our Shipping & Delivery Policy. By purchasing from us, you agree to that policy.
Once an order has been handed to the shipping carrier, risk of loss passes to you. We are not responsible for delays caused by carriers, weather, customs, strikes, or other factors outside our control.

6. Returns, Exchanges & Refunds
Our Refund & Return Policy explains eligibility, timing, and process for returns, exchanges, or refunds. By purchasing from us, you agree to that policy.
We reserve the right to refuse returns or exchanges if items do not meet the conditions described in that policy.

7. Product Information
We try to be accurate with product descriptions, images, specs, and pricing. However, we do not warrant that product information on the Site is 100% error-free, complete, current, or reliable.
Minor variations in color, finish, texture, or packaging may occur due to lighting, manufacturing tolerances, or display settings. These normal variations are not considered defects.
We reserve the right to modify or discontinue products at any time, without notice.

8. Intellectual Property
All content on the Site — including product designs, paddle artwork, graphics, logos, photos, videos, text, page layouts, icons, and software — is owned by or licensed to ARTI and is protected by intellectual property and other laws.
You may not copy, reproduce, alter, display, publish, sell, resell, distribute, or create derivative works from any part of the Site or our products without our prior written permission.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use only.

9. Acceptable Use
You agree not to:

  • Use the Site for any unlawful purpose.

  • Try to gain unauthorized access to any portion of the Site, other accounts, or any computer system connected to the Site.

  • Interfere with the normal operation of the Site (for example: scraping, data mining, using bots, injecting malicious code).

  • Use our products or branding in a way that misleads others into thinking you are us or officially endorsed by us without written approval.
    We may suspend or block access (with or without notice) if we believe you are violating these Terms or creating risk for us or for others.

10. Disclaimer of Warranties
EXCEPT WHERE PROHIBITED BY LAW, THE SITE AND ALL PRODUCTS AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY GUARANTEES OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that the Site will be uninterrupted, timely, secure, error-free, or that defects will be corrected.
Some regions do not allow limitations on implied warranties, so parts of this section may not apply to you.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTI (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, OWNERS, AFFILIATES, CONTRACTORS, AND AGENTS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SALES, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR OUR PRODUCTS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SITE, AN ORDER, OR A PRODUCT IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT(S) AT ISSUE.
Some regions do not allow certain limitations of liability. In those regions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification
You agree to defend, indemnify, and hold harmless ARTI and our officers, directors, employees, affiliates, partners, contractors, and agents from and against any claim, demand, loss, liability, or expense (including attorneys’ fees) arising out of or related to:

  • Your use of the Site or products,

  • Your breach of these Terms,

  • Your violation of any law or the rights of a third party.

13. Governing Law / Disputes
These Terms and any dispute between you and ARTI will be governed by and interpreted under the laws of the State of Texas, USA, without regard to conflict-of-law rules.
You agree that any claim or dispute will be brought only in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.

14. Changes to the Terms
We may update these Terms from time to time. When we post changes, the “Last updated” date will change.
If you continue to use the Site after changes are posted, you are accepting the updated Terms.
